1. Pick A Name That Isn’t Taken:

Too often than not a new painter will pick a name, build a website, print business cards and then years down the road learn that another painting company in their area was called by that name too.

Sometimes…and I mean sometimes (rare) both local companies won’t care. However, most of the time someone sues the other for infringing on their company’s name. Then someone has to prove that they had the name first and it is their right to call their company by that name.

a) Check To See If Your Name is Trademarked

I’m going to say the obvious here. You don’t want to infringe on a trademark. It will cost you a lot if you do. So, before you pick your painting company’s new name be sure to use the U.S. patent and Trademark Office’s free trademark research tool. This will help you see what trademarks exist for your name…if any. It will also show you trademarks on related names or words.

Trademark infringement can carry a high cost for your business. Before you pick a name, use the U.S. Patent and Trademark Office’s trademark search tool to see if a similar name, or variations of it, is trademarked.

b) What If You Want To Incorporate Your Business

Many paint companies are incorporated. If you want to do this, the proper procedure is to contact your state filing office. This will allow you to check if your company name has already been claimed or is in current use.

Remember that just because another company is using the same name doesn’t mean you can’t use it.

If the company that uses a similar name offers different types of services and or products, then you have a good shot of being able to use that name. Or if the company is located in a different area than you, then you can most likely use the name.

Remember, even though you have the right that doesn’t stop a company with a similar name from suing you. Even if they don’t win, it could cost you $1,000s.

c) How To Register Your New Paint Company’s Name

Many new business owners don’t know how to register their new name. It is kind of confusing and that is completely normal. This section will explain what registering your business name means and how to do it. Of course every city, county, and state have different procedures but this should get you to where you need to go.

When you register your new company’s name it starts by registering your business as a “Doing Business As” or DBA or a trade name.

Remember that registering your business as a “DBA” is not the same as officially incorporating your business. Take note that registering your business as a (DBA) doesn’t provide any trademark protection.

What this does do is alert your state gov that you are doing business under a name rather than a personal name.

If you want to operate your business under your personal name, then you don’t have to go through this process.

d) How To Trademark Your Business Name?

Most of us are pretty aware of trademarks, what they mean, the trademark symbol and more. However, most of us have never officially registered a trademark before.

Trademarks are not expensive to file. For example, most trademarks will cost you under $300 to file.
A trademark protects words, names, symbols, and logos that distinguish goods and services. Your name is one of your most valuable business assets, so it’s worth protecting. You can file for a trademark for less than $300. Learn how to trademark your business name.

2. Pick A Name That is Short

I bet you have heard the acronym K.I.S.S. It stands for Keep It Simple Stupid.

Do your best to keep your company’s new name short, to the point and easy to understand.

3. Picking a Domain Name For Your Business

This one is tricky.

In fact, I am going to be very upfront with you by telling you that I
don’t feel like writing a 3,000 – 5,000 additional section to adequately
explain the dos and don’ts of this one.

Here is what I can say in as few words as possible.

Your domain name doesn’t have to include your company’s name. It can and can be beneficial but it doesn’t have to.

Often times a domain name should be chosen based on the keywords and geographical area that the company is targeting. This one decision can help boost your website’s rankings and visibility in Google and thus generate $1,000s if not $100,000s of painting jobs in the future.

4. Snatch Up Social Media Accounts For Your New Painting Company

If you haven’t heard of social media…then I would suggest you get out more.

Sites like Facebook, Twitter, Instagram, Youtube, Pinterest, and more offer social media accounts. Some of these websites offer custom options for businesses.

When you set up a social media account as a business you are kind of officially registering your business and its name with this website.

**REMEMBER THIS** NAP -Number Address Phone Number. One of the biggest mistakes small businesses make is providing variated data for their business across multiple websites.

The mistake looks like this.

Facebook has a business page for Bob’s Painting Plus but Google has that same business registered as just Bob’s Painting.

The phone number is different on Facebook when compared to directory sites like Yahoo Local, Bing Local, Kudzu, Yelp, etc…

5. Pick A Name That Communicates Your Services Quickly

If at all possible, pick a name that communicates your services, location, and quality all in one. I get that this might be an impossible task but it is important to try to get as many of these messages across as quickly as possible.

For example, if for some reason you called your painting company “Bob’s”, then nobody would immediately know what you did.

But if you picked “Bob’s Painting”, the message would quickly be understood that you paint in some shape or form.

6. Your Name Is Easy To Understand Over The Phone

Just like naming a baby you want to think about what the name sounds like when said out loud.

For example, when you talk on the phone and say your business name does the person on the other line understand it. If not and you think it would be annoying or get old fast when you have to spell it out or say it multiple times, you might want to rethink your name.

7. Pick A Name That Is Easy To Spell

Let’s face it. Small local business owners don’t have access to millions of dollars that they can use to brand a fancy new name.

8. Don't Make It Too Broad or Too Small

A name can limit you or include you into too many categories. Remember that you don’t want to be the Walmart of your business.

But you also might not be able to make it by being the niche specialist of a market that is too small.

What does this mean?

It means that you shouldn’t name your business “Door Painting Pros” if the market for painting doors is too small for making enough money.

It also means that if you are a painter, you shouldn’t name yourself “All House Work Pro” in hopes to get any handyman/trade work that deals with homes.

9. Is It Logable...How Does It Look?

I’m pretty sure logable isn’t a word but it works for this purpose. Basically the reason we added this tip is to make sure you pick a name that promotes a good logo.
